Welcome to Rooted Creative Group LLC. By accessing or using our website, services, courses, or purchasing materials from us or any brand under our management, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before accessing our services.
IMPORTANT MULTI-BRAND NOTICE: Rooted Creative Group LLC serves as a parent holding company and creative agency umbrella for multiple brands, including Rooted Creative Agency, JT Fusion Cocina, Resilient Roots Customs, and AGTNM Publishing (including victoriacortezbooks.com). Each brand may maintain separate, specific Terms of Service, User Agreements, and Refund Policies. Users are directed to visit each individual brand's website directly to review the most updated and specific Terms of Service applicable to those products or services.
1. Service Fulfillment & Digital Products
All digital products, templates, educational guides, curriculum kits, or online courses are delivered electronically. Access is granted immediately upon successful payment verification. Fulfillment is considered completed and delivered at the moment our server issues access credentials, whitelists the purchaser’s email address, or provides a download link. We maintain technical log files (including IP addresses, timestamps, and delivery notifications) to verify successful electronic transmission.
2. Refund Policy
Due to the digital and intellectual property nature of our custom branding kits, design assets, and downloadable documents, all sales of digital products and creative service retainers are final. No refunds will be issued once digital access has been granted, or work on a custom design package has commenced. For physical services (such as catering pop-ups under JT Fusion Cocina) or physical merchandise (under Resilient Roots Customs), specific cancellation and return windows are described in the respective brand agreements provided at booking or checkout.
3. Intellectual Property Rights
All materials, custom brand designs, layouts, operating binders, custom graphics, manuscript layouts, and text content created by Rooted Creative Group LLC are the proprietary intellectual property of Rooted Creative Group LLC and are protected by United States and international copyright, trademark, and trade secret laws. Sharing, copying, reselling, or distributing these materials without explicit written consent is strictly prohibited.
4. B2B Client Obligations & Design Approvals
For B2B design services, clients are responsible for providing all necessary assets, text content, and timely feedback. Project schedules rely on joint collaboration. Final design sign-offs must be submitted in writing. Rooted Creative Group LLC is not responsible for errors or omissions after final client sign-off has been received.
5. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms will be brought exclusively in the federal or state courts located in San Joaquin County, California.
